Expert Warns of Financial, Legal and Data Risks on Unlicensed Online Gambling Platforms

Unlicensed gambling platforms continue to attract online bettors with easy access and attractive offers, but the legal risks are often overlooked.

These risks become clear when users face issues such as withheld winnings or identity theft, with no clear authority to step in and resolve them.

Speaking exclusively to SportsBoom, compliance lawyer Adekunle Ade-Julius shared his view.

"The main risks of using an unlicensed gambling platform include loss of funds, data privacy risks, unfair gaming practices, cybersecurity threats, and no reliable dispute resolution," Ade-Julius told betting experts SportsBoom.co.za. 

What Bettors Are Exposed To 

Unlicensed gambling platforms expose bettors to a range of risks that are often not immediately visible at the point of sign-up. 

These risks can include financial fraud, weak account security, and limited user protection. 

Adekunle explained that unlicensed operators often lack proper customer due diligence and transaction monitoring systems, making them more vulnerable to misuse by criminal networks. 

Users may also be exposed to unauthorised transactions and payment card fraud.

"If the platform suddenly shuts down or disappears, you may lose access to any money you have deposited. This is a common risk with unregulated platforms that hold customer funds," Adekunle added. 

"Your personal and financial information may not be properly protected. Without regulatory oversight, the platform could misuse, sell, or expose your data to third parties or cybercriminals." 

Adekunle further stated that there is usually no independent authority checking whether the games, odds, or results are fair, leaving users without assurance that the platform is operating honestly.

What Happens When Things Go South 

When disputes arise on unlicensed gambling platforms, users often find themselves with very limited options for recovery.

On the issue, Adekunle revealed that "commonly, the platform may simply ignore customer complaints, delay withdrawal requests indefinitely, or suspend user accounts without providing a clear explanation." 

"In some cases, operators introduce unfair terms and conditions after a player has won, using them as a basis to withhold payments."

"More concerning is that some unlicensed platforms can shut down without warning and disappear with customers' funds, leaving users with little or no recourse."

Legal Exposure And Regulatory Gaps Often Overlooked 

Gambling platforms without a license expose users to risk when problems arise. 

Unlike licensed platforms, there is no regulator overseeing the platform or ensuring it follows rules meant to protect users. 

Regulatory protections become harder to enforce when unlicensed operators are based outside the jurisdictions in which they offer services.

This creates a cross-border enforcement gap that limits regulatory control.

As a result, bettors may struggle to identify who owns the platform or which authority has the power to intervene in disputes.

According to Gaming Compliance International (GCI), about 78% of global online gambling revenue comes from unregulated operators, compared to 22% from licensed platforms.

The report also estimates unregulated online gambling at roughly $5.9 trillion in 2025.

Meanwhile, in 2024, INTERPOL's Operation SOGA X, conducted between June and July, resulted in more than 5,100 arrests. It also led to the recovery of over $59 million linked to illegal football gambling operations across 28 countries and territories.

Why Licensing Is Essential For Bettor Protection

Licensing plays a key role in determining the level of protection available to bettors when issues arise on gambling platforms. 

Licensing systems include stricter regulators such as the UK Gambling Commission (UKGC) and the Malta Gaming Authority (MGA). 

Offshore licensing jurisdictions such as Curaçao and Anjouan also issue licenses to international gambling operators under different regulatory frameworks.

Adekunle said licensing is essentially the backbone of trust and accountability in the gambling industry. It's what separates a regulated operator from one that can act without oversight.

"When a gambling company is licensed, it is subject to a formal regulatory framework that requires it to meet strict operational and compliance standards. This includes financial protection, fairness and transparency, strong compliance controls (AML & KYC), data protection and cybersecurity standards, clear dispute resolution channels, regulatory oversight and enforcement."

"Licensed gambling operators are required to comply with regulatory standards designed to protect consumers. In Nigeria, the National Lottery Regulatory Commission (NLRC) oversees federal-level lottery and gaming activities."

The Bottom Line For Bettors

Adekunle warned that many bettors underestimate how difficult it can be to recover funds or resolve disputes when using unlicensed gambling platforms.

He stressed that licensing ensures accountability, transparency, and user protection within the gambling ecosystem.

In simple terms, the risk is not just "will I win or lose my bet?" but who handles your money, how your data is used, and whether the gambling platform operates within legitimate legal boundaries.
